Manesco turns 30 years old with a refined sense of public law in the country

30 years ago, Manesco, Ramires, Perez, Azevedo Marques Sociedade de Advogados were born.


The firm, one of the main references in public law in the country, completes 30 years of existence in November 2021 and seize the date to commemorate and remember the three decades of existence.


Creation
The founders, all with experience in Administrative Law and with some relationship with Public Law, got together and decided to invest in their own firm.


The firm was founded on November 18, 1991, at a time marked by the recent validity of the 1988 Constitution and institutional transformations that inaugurated a new stage in relations between the state and society in Brazil and marked the trajectory of the bank with its involvement in actions and programs, at all federal levels, aimed at improving partnerships between the public and private sectors.


Physical structure
Three decades ago, the firm maintained a physical structure of some small rooms in the center of São Paulo. After different addresses, today the office is located on Avenida Paulista, in São Paulo, with units in Brasília, Belo Horizonte and Rio de Janeiro, in addition to having correspondents throughout the country.


Expertise
Altogether, there are more than 70 lawyers engaged in important causes that reinforced the expertise of the firm. In telecommunications, for example, Manesco helped to write the LGT (General Telecommunications Law), in addition to advising on the creation of Anatel and on the publication of several of the regulations that are still in force.


In concessions, in the 1990s, he was involved in the first highway concession projects in the State of São Paulo. Then, in the 2000s, Manesco worked on the preparation of projects that would be converted into Law 11.079/2004, the PPP Law, and Law No. 11.445/2007, the Law of National Guidelines on Basic Sanitation, among other matters legislative and economic regulation.


With a diversified knowledge, which includes the recognition of performance in the field of regulation of several sectors of the national infrastructure, the office has, in its trajectory, been assisting clients in several rounds of highway concessions, state and federal; intense experiences with the electricity sector during the blackout crisis in the 2000s; advised the construction consortium in the preparation and negotiation of a terminal construction contract in the Port of Santos (SP); consultancy to the main entities in the country's oil sector, public-private partnerships in areas such as sanitation (water and sewage and solid waste), public health, public consortia, ports, urban mobility, road and rail transport, etc. in addition to involvement in investment programs for the 2014 World Cup and the 2016 Rio Olympics.


Future
The firm still has a lot to offer. Today and for the future, Manesco is present in discussions about ongoing changes in the institutional environment, such as the new bidding legislation, the change in the law on improbity and the new legal framework for basic sanitation, among others, alongside the works related to the profound paradigm shifts that digital communication technologies have been promoting in the economic environment, with an emphasis on innovative and disruptive business models, based on new technologies and that reach all business lines and all institutional discipline in development for protection of privacy and the many issues that emerge in the scenario of our time.


 

O Superior Tribunal de Justiça (STJ) reconheceu que não deve existir a incidência de PIS/Cofins sobre tarifas de interconexão e roaming da Oi. A decisão do colegiado da 1ª Turma do STJ está prestes a ser questionada pela Fazenda Nacional e o caso deve passar também pela 2ª Turma do Tribunal, que poderá criar um impasse para ser resolvido pela Primeira Seção do STJ se não houver a mesma interpretação entre as Turmas. Além disso, a Fazenda tem a possibilidade de acionar o Supremo Tribunal Federal.

De acordo com o advogado Hendrick Pinheiro, a interpretação beneficia o setor, mas traz um desequilíbrio na relação das grandes operadoras com MVNOs operando no sistema de autorizatárias. O coordenador da Comissão Nacional de Ética em Pesquisa (Conep), Jorge Venâncio (foto), abriu uma vaquinha digital alegando que precisava de recursos para custear a sua defesa em um processo. Entre os doadores, no entanto, constam pessoas com estudos recentemente aprovados pela Conep e pessoas investigadas pelo órgão. Especialistas apontam que o ato pode incorrer em crimes.

Para o advogado Lucas Cherem, Venâncio deve se abster de deliberar sobre qualquer matéria que envolva os doadores, pois não terá a isenção necessária. Não agindo assim, segundo o advogado, ele poderá perder seu mandato.
